From Domination to Care: A Moral-Legal Framework for Sustainable Environmental Development

چکیده

Prevailing theories and policies of development frequently cast nature as a resource or tool to meet human needs. This perspective, even within the framework of sustainable development, perpetuates an anthropocentric and exploitative approach to the nature. Drawing on the ethics of care framework, this article reexamines the human-nature relationship. By Applying care ethics and conceptualizing the Earth as an "other," we can view nature not merely as an object or commodity but as a moral entity, vulnerable and worthy of care. The aforementioned considerations influence legal and traditional perspectives on environmental responsibilities, shifting the basis of liability from actual harm to care and the prevention of conditions that may lead to future harm. Sustainable development, therefore, calls for an ethical reorientation, prioritizing care, interdependence, and moral attentiveness over purely utilitarian approaches. Through a descriptive-analytical method and engagement with library-based sources, this study examines this concept and its broader implications.
